1. About this policy
BodiSense Pain Relief ("we", "us", "our") operates an integrative health clinic at Unit 2, 8 Old Collier Road, Morley WA 6062. This policy explains how we collect, use, disclose, store and protect your personal information when you visit our website, submit an enquiry, or attend our clinic.
2. Information we collect
We may collect the following types of information:
- Contact details — name, email address, phone number.
- Booking details — the service and time you choose, your appointment history with us, and any notes you provide when booking.
- Payment information — we do not see or store your full card details. Online deposits are handled by our payment provider, and we retain only a payment reference and the amount.
- Health information — any details you choose to share about your condition, symptoms, treatment history or health goals, including through our online client intake form before an appointment. Health information is "sensitive information" under the Privacy Act and is collected only with your consent and only to provide you with health services.
- Technical information — IP address, browser type, pages visited, time of visit, and similar data automatically recorded in our server access logs.
- Anti-spam verification data — when you submit our enquiry form, Google reCAPTCHA may collect hardware and software information (such as device data, browser data, IP address) to distinguish humans from bots.
3. How we collect it
- Directly from you via our online enquiry form, by phone, by email, or in person at the clinic.
- Automatically through our web server when you visit the site (access logs).
- From third-party services we use to operate the website (Google reCAPTCHA for anti-spam).
4. Why we collect it
- To respond to your enquiry and arrange your appointment.
- To deliver the health services you have engaged us for, and to maintain accurate clinical records.
- To process private health fund claims via HICAPS, with your consent.
- To protect our website from spam, fraud and abuse.
- To comply with our legal and professional obligations, including health records retention requirements.
5. Sensitive information
Health information is treated as sensitive information under the Privacy Act. We will only collect, use or disclose your health information with your consent, and only for the purpose of providing health services or where required or authorised by law.
6. Who we share your information with
We do not sell your personal information. We may disclose it to:
- Practitioners and reception staff working at our clinic who need it to provide your care.
- Service providers who operate our systems on our behalf — including providers that deliver our email and text messages, process online payments, host our website, and help us understand how the site is used. They may only use your information to provide that service to us.
- Google reCAPTCHA — used for anti-spam verification on form submissions; subject to Google's Privacy Policy and Terms of Service.
- Your private health fund and HICAPS, with your consent, to process rebate claims.
- Law enforcement, regulators or other parties where we are required or authorised by law to disclose information.
7. Overseas disclosure
Some of our service providers store or process data outside Australia, including in the United States. We take reasonable steps to ensure these providers handle your information in a manner consistent with the Australian Privacy Principles, including relying on their published privacy commitments and contractual safeguards.
8. Storage, security and retention
We store your information using secure systems and apply reasonable physical, technical and organisational measures to protect it against loss, misuse, unauthorised access, modification or disclosure. Web server access logs are retained for 30 days and then automatically purged. Clinical records are retained for the periods required by applicable health records and professional obligations (typically a minimum of 7 years from the last attendance, or longer for minors).
9. Cookies and similar technologies
Our website uses cookies and similar technologies for two purposes: to keep the site working and secure (including anti-spam checks on our forms), and to measure how the site is used so we can improve it. Some of these measurement tools are provided by third parties and may also be used for advertising purposes. You can block or delete cookies in your browser settings; the booking and enquiry forms will still work.
10. Direct marketing
We may use your contact details to send you appointment reminders, follow-ups about your treatment, and occasional updates about our services. We will only send marketing communications where you have consented (either expressly, or where the law permits in the context of an existing client relationship). You can opt out at any time by replying to any message we send, or by contacting us using the details below. Our communications comply with the Spam Act 2003 (Cth).
11. Access and correction
You have the right under the Privacy Act to request access to the personal information we hold about you, and to ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, please contact us using the details below. We will respond within a reasonable time. A reasonable cost-recovery fee may apply for access requests; correction is always free.
12. Notifiable data breaches
If we experience a data breach that is likely to result in serious harm to affected individuals, we will notify those individuals and the Office of the Australian Information Commissioner (OAIC) in line with the Notifiable Data Breaches scheme.
